Our store is hosted on SquareSpace. They provide us with the online e-commerce platform that allows us to sell our products and Services to you.

This Terms of Service and Liability Waiver ("Agreement") is entered into between the user, hereinafter referred to as "Client" or "You," and The Rosey Method, LLC hereinafter referred to as the "Business." By using the Business's website and any services provided by the Business, you acknowledge and agree to be bound by the terms and conditions set forth in this Agreement.

1. Assumption of Risk:

You understand and acknowledge that participation in any online personal training program or fitness-related activities may carry inherent risks. These risks may include but are not limited to muscle soreness, strains, sprains, fractures, cardiovascular complications, or other injuries. You voluntarily assume all such risks and accept full responsibility for your actions and decisions during the course of any program or service provided by the Business.

2. Release of Liability:

In consideration of participating in any online personal training program or using any service provided by the Business, You agree to release and discharge the Business, its officers, directors, employees, contractors, agents, and any associated individuals or entities (hereinafter collectively referred to as "Released Parties") from any and all liability, claims, demands, actions, or causes of action, which may arise out of, result from, or relate to any injury, loss, damage, or death that may be sustained by You or any property owned by You during the course of the program or service.

3. Waiver of Claims:

You agree not to bring any claim, lawsuit, or legal action against any of the Released Parties for any injury, loss, damage, or death resulting from participation in the program or use of the services provided by the Business.

4. Indemnification:

You agree to indemnify and hold harmless the Business and its Released Parties from any and all costs, including attorney's fees, arising from or related to any claims, actions, or lawsuits brought by third parties against the Business or its Released Parties as a result of Your actions or omissions during the program or use of the services.

5. Full Understanding:

You acknowledge that You have read and fully understand the terms of this Agreement and voluntarily agree to its contents. You further acknowledge that You are participating in the program or using the services willingly and of your own free will.

6. Legal Jurisdiction:

This Agreement shall be governed by and construed in accordance with the laws of the state of Michigan, and any legal action or proceeding arising out of or relating to this Agreement shall be filed in the appropriate state or federal court located within the state of Michigan.

7. Severability:

If any provision of this Agreement is found to be unenforceable or invalid, such provision shall be severed from this agreement, and the remaining provisions shall remain in full force and effect.

8. Acceptance:

By using the Business's website or engaging in any services provided by the Business, You acknowledge that You have read, understood, and agreed to the terms and conditions set forth in this Agreement. If You do not agree with these terms, please refrain from using the Business's website or services.

By accepting these terms, You voluntarily release the Business from all liabilities, and You understand and accept the inherent risks associated with personal training programs, (whether online or in-person) and fitness-related activities.
